Chinese Perspectives on Human Rights and Good Governance”系列英文人权理论丛书由人权研究院与荷兰博睿出版社合作出版,面向海外出版发行,遵循严格审慎的择稿标准,旨在向海外同仁充分展示中国人权理论研究、人权发展实践的成果,以期推动中国人权研究学者和学术成果走向国际,增进国际社会对中国人权的了解。这是我国大陆地区高校首次在海外出版发行的人权法学科领域的专业论丛。

一、Global Governance, Conflict and China


Global Governance, Conflict and China sheds a unique perspective on China’s normative behaviour in the realm of collective security, peacekeeping, arms control, the war on terror and post-conflict justice. This analysis engages with an Asian epistemological framework whose relational thought borrows from the context – space and time alike – that informs China’s principle-driven conduct on the international plane. Through the lens of relational governance, this work develops a new theory on the relational normativity of international law (TORNIL) that identifies the interdependent sources that underpin China’s international legal argument, i.e. norms, values and relationships. Without a fertile soil in which those conflicting relationships between share- and stakeholders can be rebuilt, international laws governing (post-conflict) violence cannot restore and maintain peace, humanity and accountability.

In this first volume in the series, the contributors adopt different disciplinary approaches to look at China both in the context of its internal constraints and as a global player in the overall development of human rights. This volume presents the concept of a Human Community with a Shared Future as a new path towards the realization of human rights. This idea tries to encourage all countries and economies to focus on a shared future and common destiny for all humankind as well as to work together to build a Human Community with a Shared Future through interdependence and joint development.
The present volume consists of a collection of texts arising from conferences organized by the China Society for Human Rights Studies. The texts centre on the concept of a Human Community with a Shared Future, reflecting the current reality and extent of human rights thinking with respect to both law and policy in establishment circles in China, and helping to demonstrate the likely direction of official policy in the near future.

四、The Constitutional Identity of Contemporary China

五、The Right to Development

In The Right to Development authors offer a new path for the implementation and protection of the right to development from the new perspective of the 2030 Agenda for Sustainable Development.
Instead of emphasizing the economic perspective, this book focuses on how to realize the right to sustainable development by resolution of conflicts among the economy, the environment and society.
Integrating the value analysis into the empirical analysis method, this book expands the scope of the United Nations Declaration on the Right to Development and strengthens its practical function, extracts Chinese experiences, lessons from South Asia, local knowledge in South Africa and practice in Peru on the implementation of the right to development, and puts forward the idea of building human rights criteria in the South.
