Lecture: Judges Against Justice: On Judges When the Rule of Law is Under Attack (by Prof. Hans Peter Graver)

April 28, 2016 - Prof. Hans Peter Graver, Oslo, Norway, former university law school dean, delivered a lecture to first-year master students of the Institute for Human Rights of CUPL. Prof. Ban Wenzhan, assistant dean of Institute for Human Rights and Prof. Yang Qinhuo also attended the lecture.

The topic of this lecture——“Judges Against Justice: On Judges When the Rule of Law is Under Attack” is also the name of Prof. Hans Peter Graver’s new book. This lecture was revolving around the book. This book includes three parts, the first part is Legal War and how Judges in the western legal environment can deal with this situation in the regime change. In this part, Prof. Hans Peter Graver gave the students many cases, such as the German Nazi period and South Africa under the background of common law during 1949 colonial period. In the second part, Prof. Hans Peter Graver talked about when and where the judges should be responsible for this injustices result from the Political oppression. He also mentioned that other personnel were generally accused, while judges were rarely be charged. In the last part, he referred to the ethic orientation of the judges. Apart from the content of his book, he also spoke of the independence of justice and took Germany for example.


In the final of the lecture, professor Ban and professor Yang asked some questions and communicated with Prof. Hans Peter Graver. At the end, the participants took a group picture.
